Vacancies: The Judicial Service Commission of Kenya hereby
invites applications from suitably qualified, experienced and self - motivated
Judicial Staff with proven track record for the following positions in the
Judiciary.
1. Assistant Director, Legal Unit
(PLS 14)
1 Post
This is the Head of the Legal Unit.
He/she will be responsible to the Chief Registrar of the Judiciary.
The job holder will be responsible
for the effective and efficient management of the Legal Unit, provision of
legal advisory services and ensuring effective management of legal and
contractual risks.
Key Duties & Responsibilities:
- Receive summons and instruction on behalf of
the Chief Registrar and coordinate with external Lawyers to enter
appearance, file and cross file relevant pleadings in matters where the
Chief Registrar and or Judiciary is a party.
- Provide legal protection and risk management
advice to management especially on contract management and tendering.
- Review progress of outstanding litigation,
liaise with and manage external lawyers and Office of the Attorney
General.
- Advising, negotiate, draft, vet, review, and
interpret local and international documents, agreements, contracts,
memoranda of understanding and interpreting international and regional
treaties for and on behalf of the Judiciary.
- Ensure compliance and enforcement of Judicial
Service Commission decisions as directed by the Chief Registrar in her
capacity as the Secretary of the Commission.
- Identify strategic priority areas that require
Law reform within the Judiciary and in national Legislation and undertake
activities in that regard.
- Advise the Chief Registrar on all matters
relating to the Constitution, national legislations and County
legislations affecting the administration of Justice.
- Undertake Legal Audits to ensure the
Constitutional provisions County and national legislations, regional and
international treaties or legal documents/instruments that are attendant
to Judiciary and Judicial functions are complied with and enforced in the
Judiciary.
- Provide leadership and ensure efficient and
effective management of staff and resources in the Legal unit.
Qualifications and Experience
The candidate must:-
- Have a Bachelors Degree in Law from a
recognized institution;
- Have a Masters Degree in Law from a recognized
institution;
- Be an Advocate of the High Court of Kenya;
- Have a minimum of seven (7) years’ post
admission experience in legal practice with focus on Litigation,
Commercial & Conveyancing, Government Contracting, Public Finance,
Employment & Labour Relations, Governance, Policy, Regulatory and
Statutory compliance;
- Be proficient in Computer applications; and
- Have good personality and integrity.
2. Principal Legal Officer
(PLS 13)
1 Post
The Principal Legal Officer will be responsible to the Assistant Director, Legal Unit.
Key Duties & Responsibilities:
- Review and draft contracts, agreements and
internal policies and ensure that they are in compliance with all
statutory or legal requirements.
- Review progress of outstanding litigation,
liaise with and manage external lawyers and Office of the Attorney
General.
- Coordinate with external Lawyers and the
Office of the Attorney General to review draft demand letters, plaints,
defences, applications and various pleadings in contentious Civil,
Criminal, Commercial and Conveyance matters.
- Coordinate with external Lawyers and the
Office of the Attorney General in conducting Civil, Criminal, and
Commercial litigation, Client interview and drafting of legal opinions,
notices, memoranda, motions, briefs and appeals in matters where the Chief
Registrar and or Judiciary are enjoined.
- Review all the pleadings and advise the Chief
Registrar on all actions, lawsuits and proceedings brought against any
Judges, Judicial Officer or employees acting in his/her official capacity
in any of the Court proceedings.
- Coordinate with external Lawyers and relevant
government agencies and or institute Legal proceedings for the recovery of
the illegally acquired assets and monies belonging to the Judiciary
including.
- Liaise and coordinate with other independent
state offices such as the office of Chief Justice, Attorney General and
responsible for assignment of briefs to Legal Counsel representing the
Chief Registrar or Judiciary in Court and coordinate litigations and suits
management.
- Coordinate with other government agencies and
or consultants in drafting and formulation of bills or legislative
proposals attendant to the Judiciary and advising the Chief Registrar on
the legislative and other emerging legal and constitutional matters
touching on the Administration of the Judiciary.
Qualifications and Experience
The candidate must:-
- Have a Bachelors Degree in Law from a
recognized institution;
- Have a Masters Degree in Law from a recognized
institution;
- Be an Advocate of the High Court of Kenya;
- Have a minimum of five (5) years’ post
admission experience in Legal practice with focus on Litigation,
Commercial & Conveyancing, Government Contracting, Public Finance, Employment
& Labour Relations, Governance, Policy, Regulatory and Statutory
compliance;
- Be proficient in Computer applications; and
- Have good personality and integrity.
3. Chief Legal Officer
(PLS 12)
3 Posts
The Chief Legal Officer will be
responsible to the Principal Legal Officer, Legal unit.
Key Duties & Responsibilities:
- Draft, negotiate, vet, review and approve for
execution by the Chief Registrar, contracts, leases, agreements, licences,
charges, discharge documents, transfers, security documents, preparation
and registration of conveyance documents.
- Draft demand and statuory notices and conduct
negotiations, mediation and arbitration hearings for amicable settlements
on behalf of Judiciary and advice the Chief Registrar on liability and any
quantum payable where necessary.
- Prepare bench memos, desk review reports and
written legal opinions and oral submissions when requested by the Chief
Registrar, the Directorates, Registrar or any ad hoc Committee formed
within the Judiciary, upon any Constitution or Legal questions.
- Conduct pretrial discovery, depositions and
witness preparation on behalf of the Judiciary.
- Receive, maintain and keep records of all
legal proceedings in Court or tribunal which the Chief Registrar is a
party or has interest in her capacity as the Accounting Officer and or
administrator of the Judiciary for effective case management.
- Review all the pleadings and advise the Chief
Registrar on all actions, lawsuits and proceedings brought against any
Judges, Judicial Officer or employees acting in his/her official capacity
in any of the Court proceedings.
- Conduct overall review, research, formulation
and implementation of Legal policies in the mandate areas of the
Judiciary.
Qualifications and Experience
The candidate must:-
- Have a Bachelors Degree in Law from a
recognized institution;
- Be an Advocate of the High Court of Kenya;
- Have a minimum of five (5) years’ post
admission experience in Legal practice with focus on Litigation,
Commercial & Conveyancing, Government Contracting, Public Finance,
Employment & Labour Relations, Governance, Policy, Regulatory and
Statutory compliance;
- Be proficient in Computer applications; and
- Have good personality and integrity.
