Declaration of Vacancy in the Office of Chairperson of the Judges and Magistrates Vetting Board


Pursuant to section 9(2) of the Vetting of Judges and Magistrates Act, 2011, as amended by the Vetting of Judges and Magistrates (Amendment) Act 2011, I, Mwai Kibaki, President and Commander-in-Chief of the Defence Forces of the Republic of Kenya, in consultation with the Prime Minister, declare a vacancy in the office of the chairperson of the Judges and Magistrates Vetting Board and invite applications from qualified persons for nomination for appointment to the office.

To be qualified for appointment as the chairperson, a person is required to -

(a) be the holder of a degree from a university recognised in Kenya;

(b) have at least fifteen years’ distinguished post-qualification experience in their field of study;

(c) satisfy the requirements of Chapter Six of the Constitution; and

(d) have at least twenty years’ or an aggregate of twenty years’ experience as a judge of a superior court, a distinguished legal academic, a judicial officer or other relevant legal practice in the public or the private sector in Kenya.

A person is not eligible for appointment as the chairperson if such person –

(a) is a member of –

(i) Parliament; or

(ii) a local authority; or

(iii) the executive organ of a political party; or

(b) was serving as a judge or magistrate in Kenya as of the 27th August, 2010.

Applications (together with certified copies of certificates and testimonials) should be submitted so as to be received on or before Thursday, the 2nd June, 2011.

An application should be submitted in a sealed envelope clearly marked “Application for Chairperson of the Judges and Magistrates Vetting Board” and should addressed to:

Those who had responded to the earlier announcement need not re-apply.

The names of all applicants shall be published in the Kenya Gazette.
